I. The thermometer is a constitution

Here is the short version of the century: heat is no longer a season; it is a governance problem. In 2023, the U.S. recorded 2,325 heat-related deaths—the highest in the 1999–2023 series—part of a 117% rise since the turn of the millennium. The climb accelerates after 2016, then spikes when 2023 becomes the hottest year on record. These numbers undercount; coroners still miss cases where heat is the silent accomplice to cardiac or renal failure. But the direction is explicit: up.

When a public hazard kills more Americans than floods, hurricanes, or tornadoes, the answer cannot be a PSA and a shrug. We need rules and rights—a shade treaty—that treat heat the way prior generations treated cholera or fire: as a civic engineering challenge with enforceable standards.

The good news is that pieces of this treaty already exist: a federal HeatRisk guidance map from the National Weather Service; a proposed OSHA heat standard for indoor and outdoor work; city playbooks for cool pavement, bus shelters, and tree equity; and Latin American precedents that show how to redesign the street so air moves, water lingers, and shade belongs to everyone. Mix them with American stubbornness and you get a solarpunk republic: humble technology, serious law, and neighborhoods that feel 3–5°C cooler by design, not luck.

II. Five non-negotiables (the "shade treaty," in civic plain-English)

1) A right to shade where people must wait.
If a government requires you to wait—at a bus stop, outside a clinic, in a courthouse queue—it owes you shade, water, and a seat. Los Angeles is finally acting like that sentence is law: a 10-year street-furniture contract aims to add ~3,000–3,450 new bus shelters and shade structures, with real-time info, lighting, and safety features. It took the city two decades to get here; now the kit-of-parts is ready. The metric is simple: minutes-of-shade per rider at noon in July. Publish it. Improve it.

2) A heat rule for labor.
OSHA's proposed national standard would require employers to assess heat hazards and provide water, rest, shade, acclimatization, and training for indoor and outdoor work. It's the difference between courtesy and compliance—and it finally sets floors across sectors. Until finalized, cities and states should adopt it as model code. Work should not be a fever.

3) A bilingual hazard language, enforced by calendars.
The NWS HeatRisk product gives every community a color-number index and plain-language actions. Cities should mirror those categories in Spanish and English across text alerts, signage, and media, with templates approved before June. If a resident learns "Riesgo 3 = centros de enfriamiento abiertos" in April, you have already saved a life in August.

4) Streets that stop cooking us.
Phoenix's cool-pavement program shows daytime surface temperatures drop by up to ~12°F relative to aged asphalt, with smaller but real ambient benefits. Pair that with mature trees and shade structures and you reduce heat stress without supercomputers. Cool pavement is not a panacea; it's a layer in a street that is finally designed for the body, not just the car.

5) Tree equity as civil rights.
Shade is the most local public good; we have distributed it like privilege. American Forests' Tree Equity Score makes that visible at the neighborhood scale and helps cities target planting where mortality risk is highest. Federal money exists to do this fairly; the missing piece is habit. Plant where people live and walk, not where donors picnic.

III. Three case studies (and what to steal from each)

Phoenix: write a plan you can execute
Phoenix built the nation's first Shade Plan—an update to its 2010 Tree & Shade Master Plan—that treats trees and built shade as co-equals and publishes a pragmatic inventory of where shade matters most (schools, transit, trails). It admits the 25% citywide canopy target is less useful than context-specific coverage at the curb where pedestrians actually stand. Lesson: swap symbolism for service maps, set a multilingual hotline, and measure survival rates for plantings like you'd measure on-time buses.

Los Angeles: stop apologizing for bus stops
LA's new street-furniture contract (STAP) promises thousands of shelters and stand-alone shade structures in hot corridors, with equity metrics baked into siting. If the city sticks to the schedule—and publishes monthly installs and "% of riders shaded at noon" by council district—it will do more for day-to-day climate justice than a decade of slogans. Lesson: treat shade as mobility infrastructure, not décor.

Medellín/Barcelona: redesign the block, not just the sign
Medellín's Green Corridors—tree-lined rights-of-way stitched along roads and waterways—lowered average temps by around 2°C while upgrading walkability and dignity for everyday life. Barcelona's Superblocks reorganize traffic to human scale and deliver measurable reductions in air pollution, noise, and heat; health-impact studies estimate hundreds of preventable deaths per year citywide if fully built out. Lesson: the coolest shade is structural—green networks, slower streets, fewer heat-soaking lanes—then everything else is easier.

IV. The law we already owned (but forgot to cite)

Centuries before LEED checklists, the Laws of the Indies told town builders to align streets with prevailing winds and to give the plaza arcades and shade. It was colonial law, yes, and we should never romance its context. But the bioclimatic intelligence is useful: a grid tuned to sun and breeze is not nostalgia; it's engineering. If American cities want a conservative precedent for shade as code, they can steal from 1573 without stealing valor. Put the plaza back on the wind.

V. The ledger and the calendar (how to implement this by Tuesday)

(Use the federal draft as the template so compliance survives pre-emption.) • Cool pavement + canopy bundles in priority corridors (schools, transit, clinics). Require before/after thermal imagery and public dashboards. • Tree Equity capital plan: commit multi-year dollars to the lowest-score tracts; measure survival, not just planting; publish a Spanish-language tree-care hotline.

Three years: change the geometryGreen corridors / superblocks pilots: pick two multi-neighborhood corridors and one superblock district; give them bus priority, shade canopy, and vehicle volume caps; score them on ambient temp, walking trips, ER visits, and retail receipts. • Shade Code: amend zoning and the street design manual so any required queue (transit, clinic, court) must include shade, potable water, and seating; count shade as a first-class public asset like lighting or drainage. • Right-to-Cooling operations: standard summer hours for libraries and rec centers as Cooling Commons; ES/EN staffing and signage; map tiles embedded in every city page.

VI. Metrics that matter (because a treaty without numbers is a poem)

Minutes of Shade (MoS): median shaded minutes per transit rider at noon in July. • Work Heat Compliance: % of city contractors meeting OSHA-plus requirements; # of violations remedied within 7 days. • Cooling Reach: population within 10-minute walk of a Cooling Common open after 7 p.m. on HeatRisk 3–4 days. • Surface Temp Delta: °F difference on treated versus untreated streets at 3 p.m. in July (Phoenix shows ~up to 12°F on surfaces). • Tree Equity Lift: average Tree Equity Score increase in bottom-quartile tracts year over year.

Publish the dashboard in Spanish and English. This isn't branding; it's how residents know the city loves them back.

VII. The counterarguments (and why they melt)

"It's too expensive."
No—what's expensive is heat-sick workers, productivity loss, ER surges, and power peaks. Medellín's 2°C cooling via green corridors cost roughly $16.3M total—about $6.50 per resident—and now saves energy and lives annually. The U.S. has already set aside billions for urban forestry and resilience; we're arguing about calendars, not money.

"Trees die."
Yes. Plant bigger stock where survival rates are proven, budget for maintenance like you do for streetlights, and measure survival. Phoenix's new plan is honest about this and shifts from vanity totals to context-specific shade.

"Cool pavement glares."
Early coatings did. Newer specs address reflectivity and skid. Phoenix's Phase 2 evaluation is unromantic about trade-offs: surface temps fall; ambient gains are modest; life-cycle benefits and safety depend on the block. That is what grown-up policy looks like.

"Bilingual alerts are 'political'."
No, they're clinical. The Weather Service already provides a risk lexicon; your job is to match it in the tongues people use at home. The electorate is bilingual by practice even when the statute book pretends otherwise.

VIII. Three scenes from a cooler republic

South Phoenix, 2:13 p.m.
A mother and a toddler reach a bus stop under a new shade blade. The ground is a cooler coating, the shelter beacon shows the next bus in 5. The toddler falls asleep on her shoulder. That is public health, measured as a nap.

Hialeah, 6:02 p.m.
A HeatRisk 3 alert pings phones in ES/EN: "Drink water. Check on older neighbors. Cooling centers until 9 p.m." The church gym is open; the kid at the desk speaks both languages. No one argues about politics; they argue about the Marlins.

Medellín, 8:41 a.m.
Cyclists glide under Green Corridors where buses once roasted. The air feels like a promise someone kept. Barcelona's superblock pilot is loading at home on a laptop in Tucson; an engineer is copying it like a recipe. The future is a kit you can borrow.

IX. Epilogue: courtesy, cast as shade

Vonnegut would have nodded; Borges would have indexed the corridors. I'll settle for a simpler virtue: courtesy, measured in degrees. Shade is not charity. It is the public's quiet claim on comfort and time, the right to stand in a city without being punished by its physics. The shade treaty is a pact to build like we meant to share.

Give people a shadow and they will give you back a summer.
